These Terms of Service ("Terms") govern your use of the Drift mobile application ("the App"), developed and published by Hollow Tree EC, LLC ("we," "our," or "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
Drift is a sleep and alarm application that provides sleep sounds, alarm scheduling, wake-up missions, morning briefings, and sleep tracking. The App is available as a free version with limited features and as a paid Premium subscription with full access to all features.
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent that you meet this age requirement.
Drift does not require an account to use the free version. If you subscribe to Premium and enable Cloud Sync, an account is created using an anonymous identifier. You are responsible for maintaining the security of your device. We are not liable for any loss resulting from unauthorized access to your device.
Drift Premium is available as a monthly subscription, an annual subscription, or a one-time lifetime purchase. Current prices are displayed in the App and on the App Store. Prices may vary by region and are subject to change.
All payments are processed through Apple's App Store. We do not directly collect or process payment information. Monthly and annual subscriptions renew automatically unless you cancel at least 24 hours before the end of the current billing period. You can manage and cancel your subscription at any time through your Apple ID settings (Settings → [Your Name] → Subscriptions).
Refund requests are handled by Apple. To request a refund, visit reportaproblem.apple.com or contact Apple Support.
New users may be offered a free trial of Premium features. If you do not cancel before the trial period ends, your subscription will begin automatically at the displayed price.
You agree not to reverse engineer, decompile, or disassemble the App; use the App for any illegal purpose; attempt to gain unauthorized access to our servers or services; redistribute, sublicense, or resell the App or its content; or interfere with the App's normal operation.
The App, including its design, code, sounds, graphics, and content, is owned by Hollow Tree EC, LLC and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. Sound files included in the App are licensed for use within the App only.
While we design Drift's alarm system to be reliable, we cannot guarantee that alarms will fire in all circumstances. Device settings (such as Do Not Disturb, silent mode, or low battery), operating system behavior, and other factors outside our control may affect alarm delivery.
You should not rely solely on Drift for critical wake-up situations. We recommend using the App in combination with a backup alarm for situations where failure to wake up would have significant consequences. We are not liable for any damages resulting from an alarm failing to sound.
Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOLLOW TREE EC, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Hollow Tree EC, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or your violation of these Terms.
The App may integrate with third-party services (Apple HealthKit, Apple WeatherKit, Apple Music, Spotify, Siri Shortcuts, HomeKit). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date and providing notice within the App for significant changes. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
We may terminate or suspend your access to the App at any time for violation of these Terms. You may stop using the App at any time. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) will remain in effect.
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of law provisions.
